Buying property in Israel: the attorney and the caveat

Why Israeli real-estate deals use an attorney, what a warning note (caveat) does, and how registration follows the contract.

Most apartment and land purchases in Israel are closed with attorneys, not with a separate notary-only closing. The buyer’s attorney reviews the title, encumbrances, and the contract; the seller’s attorney usually drafts. Fees often track a percentage of the price under Bar recommendations.

Warning note (caveat)

A warning note (he’arat azhara) at the Land Registry flags that a deal is in progress. It is a protective step, not a substitute for full registration. The fee differs if the same attorney already drafted the contract or handled registration.

After signing

Registration of the transfer, tax certificates, and mortgage discharges follow the contract timetable. If the attorney drafted the sale contract, a separate registration fee is often not charged. New-build purchases from a developer have a distinct review percentage.
